Desk Pal

Terms of Service

Last updated October 29, 2026

The short version

1. Agreement

These terms are an agreement between you and [COMPANY LEGAL NAME] ("Desk Pal", "we", "us"). They cover the Desk Pal robot software (the "Pal"), the Desk Pal iPhone app, our servers, and this website (together, the "Service"). By creating an account, tapping "I agree" in the app, setting up a Pal, or using the Service, you accept these terms and our Privacy Policy. If you don't accept them, don't use the Service.

You must be at least 18 and able to enter a contract. If you're using Desk Pal for a company, you confirm you can bind it.

2. What the Service does

You tap Pal's head and talk. Pal sends your voice through our servers to Google's Gemini AI service, and speaks the answer. The app lets you set Pal up, change its settings, and type things for it to say. Pal needs power, a 2.4 GHz Wi-Fi network, and an internet connection to our servers to talk.

Features marked "coming soon" or "in development" aren't part of the Service yet and we don't promise them.

3. Your account

4. AI answers aren't advice

Pal's answers are generated by an AI. They can be wrong, out of date, or odd, and they can sound sure when they aren't.

5. Using Pal safely

6. Rules of use

Don't:

We can limit or suspend an account that breaks these rules or puts the Service or other people at risk.

7. Your content

What you tell Pal, type in the app, or write in its settings is yours. You give us a limited, non-exclusive license to process it for one purpose: running the Service for you, including sending it to Google's AI service to produce answers. We don't claim ownership of it and we don't use it to advertise to you. Don't send us anything you don't have the right to send.

8. Our software and brand

The Pal firmware, the app, the server, the designs, and the Desk Pal name and logo belong to us or our licensors. You get a personal, non-exclusive license to use the firmware and app on Pals you own, under these terms. We don't sell the software to you. Some parts use open-source software under its own licenses [LIST OR LINK THEM, e.g. a Licenses page].

9. Updates and changes to the Service

Pal updates itself over Wi-Fi. Updates are signed, and a Pal goes back to the previous version if an update fails to start. We may add, change, or remove features, including to fix security problems or stay legal. If we're going to shut down the hosted Service or take away a main feature, we'll give you at least [90] days' notice by email and in the app, and [describe what you'll offer, e.g. a way to keep Pal working or a refund for recent purchases].

10. Buying a Pal

Orders, shipping, returns, and the hardware warranty are covered by the order terms shown at checkout [WRITE ORDER TERMS + LIMITED WARRANTY BEFORE SELLING]. Nothing in these terms takes away rights you have by law, such as legal guarantees for consumers in the EU, UK, and elsewhere.

11. Other companies' services

The Service uses other companies' products, including Google's Gemini AI and Apple's App Store. Their terms apply to your use of them. We aren't responsible for their services or for outages that come from them.

For the iPhone app: this agreement is between you and us, not Apple. Apple has no duty to provide support or maintenance for the app, and isn't responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you. You confirm you're not on a US government embargo or prohibited-party list.

12. No warranties beyond the law

The Service is provided "as is" and "as available". To the fullest extent the law allows, we don't make any promises that it will be uninterrupted, error-free, secure, or that the AI's answers will be accurate or fit for a particular purpose.

Some places don't allow these exclusions, so some of them may not apply to you. Nothing here limits any warranty or consumer right that the law doesn't let us limit.

13. Limits on our liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from the Service. Our total liability to you for anything related to the Service is limited to the greater of what you paid us in the 12 months before the claim or [US$100].

This doesn't limit liability that can't be limited by law, including for death or personal injury caused by our negligence, for fraud, or for anything else the law says we can't exclude.

14. If you misuse the Service

If your misuse of the Service, or your breach of these terms, causes a third party to bring a claim against us, you'll cover our reasonable losses from it, to the extent the law allows. This doesn't apply to consumers where the law forbids it.

15. Ending things

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the Service (with notice as in section 9). When an account ends, section 7's license ends, we delete your data as described in the Privacy Policy, and the sections that by nature should survive (4, 8, 12, 13, 14, 16) do.

16. Disputes and governing law

These terms are governed by the laws of [STATE / COUNTRY], without regard to conflict-of-law rules. If you live in the EU, UK, or another place with mandatory consumer laws, those laws still protect you, and you can bring a claim in your home courts.

Before filing anything, email us at [LEGAL CONTACT EMAIL] and give us 30 days to try to fix it. Either of us can use small-claims court for a claim that fits there.

[OPTIONAL, have a lawyer confirm before keeping it: Any dispute not settled that way will be decided by binding individual arbitration run by [AAA / JAMS] under its consumer rules, not in court and not as a class action. You can opt out of arbitration within 30 days of accepting these terms by emailing us. Arbitration clauses aren't enforceable for consumers in some places, and the rules for them are strict, so this clause needs a lawyer's eye.]

17. Changes to these terms

We may update these terms. If a change matters, we'll tell you in the app or by email before it starts, and we'll ask you to accept it if the law requires. If you keep using the Service after the change starts, you accept it. If you don't agree, delete your account and stop using the Service.
